Abstract

The selection of the research came based on the bias of modern research to the nonverbal evidence represented by consensus and the evidence of reason, and I preferred the statement of the study of the two evidence, which has an impact on the subject of jurisprudential applications, especially on topics that the jurist lacks inference by referring to the verbal principles, and which extends its bridges to non-verbal evidence in order to The legislative system is integrated in the derivation of the legal rulings of the jurist, and this will be highlighted in the folds of the research, and given the great respect and appreciation of Al Muhaqqiq Al-Hilli , and noting the great scientific heritage he left, I considered studying the fundamentalist structures in his non-verbal evidence.
The research looks forward to studying the non-verbal evidence that was the subject of controversy among the jurists regarding how to use them to derive legal rulings, as consensus is a matter of controversy between the two parties, and dealing with it became not by noticing its own value, but by noticing its disclosure about the position of the Latent year it, so the extent of its disclosure determines its consideration and its indicative value.
