He engaged in documenting and studying comparative jurisprudence, with one of his significant works in this domain being "Tadhkira al-Fuqaha" where he discussed the doctrines of Muslims, their opinions, evidence, and evaluated the validity of their arguments.
This study aims to highlight the scientific aspects raised by this scholar, presenting an example from his book, particularly focusing on the issue of fasting for traveler. The Author discussed his approach in evaluating narrations, his role in the birth of the "Sanad School" in Imami thought, and the quadruple classification of hadiths in his book "Muntaha al-Matalib fi Tahqiq Al-Madhhab." And explored his presentation of evidence from other schools of thought, his attempt to evaluate and differentiate between the authentic and weak narrations, and his endeavor to reconcile conflicting narrations. Additionally, the author examined his discussions and directives for the second sect of narrations that contradict the apparent meaning of the Quranic verses, emphasizing the necessity of referring narrations to the Quran and Sunnah.
2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/274 Al-Allama Al-Hilli in the Ka'abi's Dispute 2024-02-08T07:38:46+00:00 Rouhallah Malekian Rmalekian1345@gmail.com
Al-Allama al-Hilli stated that the term "Ka'abi" in the ablution verse refers to the joint between the shin and the foot. He opposed the widely accepted view that considers it to be the top of the feet, supporting his argument to the Hadith of the Sahih al-Akhween, the narration of Ibn Babawayh, linguistic analysis, and the views of some scholars who deviated from the mainstream opinion, such as Shahidain and al-Karaki. They criticized him for various reasons, including contradicting the language, derivation, statements of the companions, explicit reports, and the consensus of scholars, in addition to the allegation of going against the consensus of the nation. Sheikh al-Bahai responded to these criticisms, and some scholars who disagreed with him later presented counterarguments. Meanwhile, others attempted to reconcile al-Hilli's statements with the commonly accepted view or suggested alternative interpretations.
In this research, we present the words of the companions, linguists, al-Allama al-Hilli, his critics, Al-Bahai, and those who came later in this debate. We aim to clarify the truth in this contentious matter.
2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/275 The Concept of Inception from the Perspective of the Scholars of the Hilla School 2024-02-08T07:44:54+00:00 Dr. Ibrahim Noyi E_noei@sbu.ac.ir Translation: Raad Al-Hajjaj noe@sbu.ac.ir
What does the methodological difference between the scholars of the Hilla School and their predecessors in explaining, proving, and defending doctrinal teachings imply, especially regarding the concept of inception? The answer to this question becomes apparent only through a careful examination of what the famous theologians of the Hilla School have detailed and by comparing their views with those of other prominent theologians. This study aims to clarify the Shiite doctrinal developments concerning the concept of inception within this school.
The comparison revealed fundamental differences in the general idea of inception and the issue of its occurrence, especially regarding the Imamate of Isma'il Ibn al-Imam al-Sadiq (Pace be upon him), among the scholars of al-Hilla School and other Shiite theological schools. Most scholars of this school do not address reports indicating the attribution of inception to Allah. They also do not observe the transformation of inception into the doctrine of abrogation. Additionally, they do not explain the nature of inception and its transformation into abrogation at all. Some scholars did not mention the report of inception in the Imamate of Isma'il Ibn al-Imam al-Sadiq (Pace be upon him), while others directed attention to this report and had specific interpretations.
2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/276 Al-Allama Al-Hilli's Position in the Science of Logic 2024-02-08T07:54:20+00:00 Prof. Dr. Mohammad Ghafouri Nejad ghafoori_n@yahoo.com Prof. Dr. Ahad Faramarz Garamaleki ghmaleki@ut.ac.ir
Al-Allama al-Hilli, one of the geniuses of logicians, holds a significant position in the history of logic in Islamic civilization. However, his elevated position in various religious sciences has somewhat overshadowed and prolonged his journey in logic. Al-Hilli authored over twenty books on logic, covering short essays and comprehensive works spanning across logic, natural sciences, and theology. He also engaged in critiquing philosophers and wise men of his time, leaving an impact on summarization. Most of his writings on logic and philosophy consist of commentaries on the works of past scholars.
The multitude of al-Hilli's research and contributions to logic can be attributed to his belief that avoiding logic marks the beginning of a superficial and undeveloped religious vision. The influx of trivial ideas mixed with superstitions in the field of religious thought and contemplation increased Al-Hilli's dedication to developing the science of logic as a solid foundation against the superficial and shallow wave in religious thought that posed a threat. The majority of al-Hilli's logical heritage follows the format of twofold logic, employing signs and indications in his logical works.
2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/277 The Philosophical Orientation of Al-Allama Al-Hilli 2024-02-08T08:16:17+00:00 Dr. Saleh Mahdi Saleh Salih.mministry@uomustansiriyah.edu.iq
The scientific contributions of al-Hilli encompassed diverse fields of knowledge, including jurisprudence, principles of jurisprudence, theolo-gy, and philosophical issues that imposed their presence in his mind. Consequently, he expressed his thoughts using various linguistic styles, all originating from a singular intellect. He pondered upon metaphysical and doctrinal matters, such as individual essence and the creation of the world, using a unified mind that consistently approached these subjects. Undoubtedly, these themes constituted introductory foundations for proving the divine existence.

2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/278 Political Dimensions in the Debates of Al-Allama Al-Hilli 2024-02-08T08:22:21+00:00 Hussein Jawad Musa Al-Kindi hjwd_xp@yahoo.com
This research aims to elucidate the nature of the conceptual formations in the most important discussions of Islamic theology, specifically addressing the issue of Imamate in the perspective of al-Hilli and its political dimensions. These dimensions surfaced in a va-riety of debates in which he participated throughout his life, enhancing his scholarly standing. He emerged as a pioneer of religious reform in an era marked by innovations, deviations, and conflicts ignited by some self-proclaimed scholars who were contempo-raries of al-Hilli, such as Ibn Taymiyyah and those of a similar mindset. The findings of this research focus on dispelling the ambiguity surrounding the theological aspect of al-Hilli's scientific movement, manifested in his historical role in promoting the Shia heritage in various forms of knowledge. This extends from the Hilla school to Jabal Amel, Iran, al-Ahsa, and all corners of the world. The research also highlights his active role in solidify-ing the theological principles of the Hilla school.
2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/279 Positivism Theory between Al-Allama Al-Hilli and Contemporary Linguistics A Comparative Study on the Origin of Language 2024-02-08T08:32:09+00:00 Sheikh Osama al-Atabi osamaahmeedalatabee@yahoo.com
The scholars of foundational studies had a significant impact on linguistic studies as they delved into the discussions of linguistic evidence. This was because linguistic evi-dence served as their tool for deducing legal judgments, and their interest in language aimed at achieving accurate deduction of legal rulings through a correct understanding of Quranic verses or noble prophetic traditions. Their semantic researches were more pro-found than that of linguists themselves. Al-Hilli (d. 726 AH) presented jurisprudential and foundational opinions considered among the most important in the ideological aspect. The choice of the topic was due to the high status and distinguished position held by this scholar. The goal was to extend his views from the scope of traditional Hawza studies to the academic linguistic studies, facilitating the exchange of ideas between the two institu-tions to present his contemporary intellectual thought. The research comprises three sec-tions that discuss the positivism theory and the reality positivism through al-Allama al-Hilli's book "Nihayat Al-Wusul Ilaa Eilm Al-Usul" It also includes a brief reading on the significance of this book and its significant impact on linguistic and foundational studies, comparing it with modern and contemporary linguistic studies.
2023-12-28T00:00:00+00:00 Copyright (c) 2024 https://almuhaqaq.alamaalhilli.org/index.php/almuhaqaq/article/view/280 Three Issues by Al-Hilli and Al-Hilli Al-Hasan Ibn Yusuf Al-Mutahhar (d. 726 H) 2024-02-08T08:50:46+00:00 Saeed Al-Jamali mhos13687@gmail.com
This research encompasses three new jurisprudential issues by the esteemed al-Allama al-Hilli with the following titles:
1.The First Issue: Ten Jurisprudential Questions Answered by al-Allama al-Hilli.
2.The Second Issue: Some Fatwas Narrated from al-Allama al-Hilli.
3.The Third Issue: Correspondence between al-Allama al-Hilli and the Judge Al-Baidawi on a Jurisprudential and Legal Matter.

2023-12-28T00:00:00+00:00 Copyright (c) 2024
