Abstract

Moving away from the age of the text necessitates moving away from the partial clues to the knowledge of the issuance of the text and not its issuance and understanding the text, and adhering to the single news is not sufficient to seize the Sharia from its original sources because it is partial evidence that most of the Shari’a does not draw on its complete structures, and what prepares the methodology for the rules for revealing this structure is the drawing The patriarchal generality is different from specification, because it is possible to distinguish between sound evidence from the sick one. Ibn Idris Al-Hilli & checked through a method that insures from falling into corruption or losing interest. We claim in this research that it adheres to three things: the clues that require knowledge of the issuance of the news, the evidence of reason and the fundamentals of the doctrine. It seems that the original pillar of these three is the origins of the doctrine, as he explained it sometimes with rational evidence, and sometimes with a general, unanimous or unanimous rule, or unanimous judgment, or a rule he claimed to be definitive.
